End-User License Agreement

This End-User License Agreement ("EULA") is a legal agreement between you ("you" or "Licensee") and Tide Forge Games ("we," "us," or "Licensor") for the Virtual Playmat software application, including any associated media, printed materials, and "online" or electronic documentation (collectively, the "Software").
By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
1. Grant of License
Subject to your compliance with the terms and conditions of this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use one copy of the Software on a personal computer that you own or control for your personal, non-commercial entertainment purposes.
2. License Restrictions
You agree that you will not, under any circumstances:
- a. Sell, rent, lease, sublicense, distribute, or otherwise transfer the Software or any copies thereof to a third party.
- b. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code for the Software, in whole or in part, except as and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
- c. Modify, adapt, or create derivative works based on the Software.
- d. Remove, alter, or obscure any copyright, trademark, or other proprietary notices on or in the Software.
- e. Use the Software for any commercial purpose or for the benefit of any third party without our express written consent.
- f. Use the Software to violate any applicable law or regulation.
3. Ownership
The Software is licensed, not sold, to you. We retain all right, title, and interest in and to the Software, including all copyrights, trademarks, trade secrets, and other intellectual property rights therein. The license granted to you confers no title or ownership in the Software and should not be construed as a sale of any rights in the Software.

By agreeing to this EULA, you also agree to the terms of these policies.
5. Term and Termination
This EULA is effective until terminated. Your rights under this license will terminate automatically without notice from us if you fail to comply with any term(s) of this EULA or any of the related policies. Upon termination, you shall cease all use of the Software and destroy all copies, full or partial, of the Software.
6. Disclaimer of Warranty
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Governing Law
This EULA and the relationship between you and us shall be governed by the laws of the State of Wisconsin, without regard to its conflict of law provisions.
9. Entire Agreement
This EULA, together with the policies incorporated by reference in Section 4, constitutes the entire agreement between you and us concerning your use of the Software and supersedes all prior or contemporaneous understandings, whether oral or written.
